By booking a tour with Newcastle Afoot you are accepting these Terms and Conditions as a binding contract without alteration. Newcastle Afoot reserves the right to update or alter these Terms and Conditions at any time, and it is the guest's responsibility to be familiar with them. The latest Terms and Conditions can always be found on the Newcastle Afoot website www.newcastleafoot.com.au and will supersede any previous versions. We’, ‘us’ or ‘our’ refers to Newcastle Afoot. ‘Participant’ or 'guest' refers to the person who has booked and/or paid for the tour.

Cancellations or Changes by Participants

Newcastle Afoot has the following cancellation policy:

  • Bookings can only be cancelled by the Participant by giving written notice to Newcastle Afoot

  • Bookings cancelled between 0 to 48 hours before the tour are not refundable

  • Bookings cancelled 48 hours to two weeks before the tour require 50% payment

  • Bookings cancelled more than two weeks before the tour will have of the full tour price refunded (less non-refundable booking deposit)

Cancellations or Changes by Newcastle Afoot

Our walking tours require a minimum of two (2) guests to commence (or 4 guests on public holidays). If the minimum number is not reached then Newcastle Afoot reserves the right to change or cancel any bookings. Newcastle Afoot reserves the right to cancel or vary this service in any way without notice. However, reasonable effort will be made to maintain arrangements as advertised.

Newcastle Afoot will not proceed should we decide that the weather makes the participation in the tour unsafe, or for any other reason, at the absolute discretion of us. If we cancel a tour we will endeavour to do one of the following:

  • Re-book you for another date or tour (subject to availability)

  • Transfer your booking to another person

  • Provide a gift voucher for the specific tour

There will be no refund of a ticket by Newcastle Afoot except in accordance with these terms or as agreed in writing by us. Refunds will only be made to the person who purchased the ticket from the Newcastle Afoot

Refunds

If the ticket or voucher was booked through a Booking Agent, the person who made the booking will be issued with a refund voucher for redemption with the Booking Agent. If the ticket was brought directly from Newcastle Afoot then we will reimburse the person who made the booking for the cost of the ticket

Participating in Newcastle Afoot Walking Tours

All Participants acknowledge and agree that they participate in Newcastle Afoot services at their own risk. All Participants are required to take reasonable steps to ensure their own personal safety on public and private land, and comply with New South Wales laws. Please practice common sense, prudence and diligence.

All Participants will be required to disclose to their Newcastle Afoot guide prior to the commencement of all tours whether the participant experiences any medical condition which may prevent the participant undertaking the tour. This include but is not limited to limb or back injury, heart conditions, severe asthma, epilepsy, dizziness, or recovering from recent surgery.

Timing & Itinerary

Newcastle Afoot will always do our best to contact you by mobile phone if you are late or missing part of the tour. However, we accept no responsibility for, and provide no refund for, participants who miss any part of the tour for any reason.

We reserve the right to alter any part of the itinerary without notice before or during the tour as circumstances dictate. We will endeavour to communicate any significant changes in a timely manner but are not liable for any changes and are not required to offer any refunds as a result of any change.

Bookings

Tickets must be paid for at the time of booking unless otherwise agreed by Newcastle Afoot. We may charge a booking fee or credit card transaction fee when paying for tickets. Tickets are non-refundable and are only valid for the booked tour unless given express written consent by Newcastle Afoot.

Pricing

All prices are quoted in Australian dollars (AUD). All prices on our website supersede all prices previously advertised. Booking fees for credit card transactions are not refundable. We reserve the right to increase or decrease advertised prices for our tours at any time.

Gift Vouchers

  • Gift vouchers are valid for 12 months from the date of purchase.

  • Gift vouchers are valid for the tour specified on the gift voucher only.

  • Gift vouchers are not redeemable for cash and are non-refundable.

  • Gift vouchers will not be replaced or refunded if lost or redeemed by someone other than the intended recipient.

  • Gift vouchers are not valid with any other special offer or package.

  • Gift vouchers can be purchased online through our booking system and redeemed through the link provided on the gift voucher email using the voucher code provided.

Private & Corporate Tours

Newcastle Afoot is available for private tours, corporate walking tours and other special events. Please contact us for more information. Any quotes provided are valid for 28 days from the date on the quote. The full amount quoted is required at the time of booking unless otherwise agreed by Newcastle Afoot. If a private or corporate booking is cancelled by you:

  • Between 0 (day of tour) and 30 days before the tour – no refund

  • More than 30 days before the tour – full refund.

Special requests by guests during the private and corporate tours are to subject to agreement by the tour guide. If the tour goes over the allocated time, an additional charge of $20 per 15 minutes or part thereof will be invoiced.

Last Minute Deals

From time to time discounted tours may be offered by Newcastle Afoot as last minute deals. Discounted tours require full payment immediately on booking. The number of places on discounted tours is subject to availability. Any discount does not apply to existing bookings and cannot be used with any other discounts. Prices are per person per tour and are subject to availability. Discount applies to selected tours only. Newcastle Afoot reserves the right to discontinue the promotion at any time without notice.

Access 

Newcastle Afoot welcomes passengers with disabilities and access needs on our small group walking tours, including people using wheelchairs. Please contact us at least 48 hours ahead of your tour to discuss your support or access needs, and we will try to ensure the tour is accessible for you. Our regular tours average 1-3km per hour and participants must be able to cover these distances.

Age Limit

Persons under the age of 18 years are not permitted on the Eat & Drink Newcastle History walking tour.

Safety

We strongly recommend wearing comfortable closed shoes on all our tours for occupational health and safety reasons. Participants on our Eat & Drink Newcastle History tour are advised not to wear sandals and thongs (flip-flops) as you may not be allowed in to venues.

By booking with us you acknowledge that participation in all our tours involves inherent risks that may not be present in other less demanding tours. These risks include, without limitation, the possibility of injury or death, psychological trauma, loss or damage to property, inconvenience and discomfort.

Service of Alcohol

Newcastle Afoot does not condone excessive or binge drinking. We promote responsible drinking of alcohol. Guests must at all times abide by state and federal laws regarding lawful drinking practices including, but not limited to, Responsible Service of Alcohol (RSA) laws, the consumption of alcohol in public places and consumption of ‘bring your own’ (BYO) alcohol. Service of alcohol may be refused to persons deemed intoxicated. As the Eat & Drink Newcastle History walking tour visits licensed premises where alcohol is served it is your responsibility to carry a valid passport, drivers licence, proof of age card, or other suitable form of identification for the duration of the tour.

Any guest who consumes, or is suspected of consuming, alcohol in a non-licensed area can be removed from the tour. They will not be entitled to any refund. Non-licensed areas may include, but are not limited to: non-licensed venues, BYO drinks on venue properties; or any public areas such as footpaths, restrooms, or parks.

Behaviour

Newcastle Afoot walking tours and local experiences are friendly, low key events, and we expect responsible, respectful behaviour from our participants. Participants are responsible for any damage they cause during the tour to property any cafes, galleries, bars or businesses we visit.

Participants must behave respectfully toward others on the tour and anyone else they meet along the way. Any person deemed unruly or disruptive can be removed from the tour and will not be entitled to any refund. Uncontrollable and disruptive drunken behaviour will not be tolerated on the Eat & Drink Newcastle Historywalking tour. There is no consumption of alcohol on the Seascapes to Laneways or Newcastle Short Walk Tours. 

Any legal action (including fines) taken against a person on the tour, or against Newcastle Afoot because of the actions of a particpant, will be the sole responsibility of that person or persons. We are not responsible for the conduct of third party operators, venues or suppliers.

Authority of the Tour Leader

At all times the decision of the Newcastle Afoot tour leader or representative will be final on all matters likely to affect the safety and well-being of the tour. This includes any decision that the tour leader makes about the on-going participation of a guest on the tour or certain activities that comprise part of the tour. This includes any person, in the opinion of the tour leader, who is affected by alcohol or other drugs (whether prescribed by a medical practitioner or otherwise). If a guest fails to comply with a decision made by the tour leader, or interferes with the well-being of the group, then the tour leader reserves the right to terminate this contract and order the guest to leave the tour immediately, with no right of refund. The matter may be also reported to the NSW Police if deemed necessary by the Newcastle Afoot tour leader or representative.

Publicity

Newcastle Afoot may ask your permission to use images or video of you taken during the tour. If you are we will use the images or video without recourse to you and without compensation to you, for publicity and promotion purposes only, through whatever medium we choose.

Privacy

Newcastle Afoot will need to collect information from you, some of which may be of a personal nature, in order to provide a service. The information may be disclosed to, or collected on our behalf by our service providers to enable the services to be provided, but will not be used by them for any other purpose.

Guest Release and Newcastle Afoot Liability

Each participant releases Newcastle Afoot, its employees and agents from liability or loss or injury to the guest from any cause, and whether due to the negligence of Newcastle Afoot or any other person. Each participant releases Newcastle Afoot from all sums of money, accounts, claims, actions, proceedings, demands and expenses which the guest at any time may have against Newcastle Afoot for or by reason or in respect of any act, cause, matter or thing. Each guest indemnifies Newcastle Afoot against:

  • All losses incurred by Newcastle Afoot

  • All liabilities incurred by Newcastle Afoot; and

  • All costs actually payable by Newcastle Afoot to its own legal representatives (whether or not under a costs agreement) and other expenses incurred by Newcastle Afoot in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any act or omission of the guest.

Booking Agents Liability

If a Booking Agent sells any tickets or vouchers on behalf of Newcastle Afoot, the Booking Agent indemnifies Newcastle Afoot against:

  • All losses incurred by Newcastle Afoot

  • All liabilities incurred by Newcastle Afoot

  • All costs actually payable by Newcastle Afoot to its own legal representatives (whether or not under a costs agreement) and other expenses incurred by Newcastle Afoot in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any acts or omissions of the Booking Agent.

Newcastle Afoot’s Discretion

Newcastle Afoot may use its absolute discretion in exercising any of the rights granted to it pursuant to these Terms and Conditions.

Governing Law and Jurisdiction 

The law of NSW governs these Standard Terms and Conditions. The parties submit to the non-exclusive jurisdiction of the courts of NSW and of the Commonwealth of Australia.
